Assuming it's the switch which is the problem (is it? - if you disconnect the switch do the lights go out?) is there some misalignment between the switch and the pedal so that the pedal bends the switch when you press it, meaning that the switch does not return to the off position later? I find it odd that the garage has simply replaced the switch without trying to find the proper cause of the problem.

Do you use a krooklock between the brake pedal and steering wheel? If so, then as you pull up on the pedal it changes the adjustment of the switch, this can also happen if you wear big boots to drive, as the clutch comes up you hit your toe under the brake pedal and move the switch.

Brake light switch is held in situ by a small plastic knurled washer.... you NEED to replace it with the switch///// the knurled section within is stripped and the switch slips out easily....
