Q: Selling an old car that wouldn't pass emissions

NOTE: THIS IS NOT a for sale-advertisement. I just want to make sure I understand what's required to make the sale.

In Colorado...

92 Civic, high miles. The car still runs, but the head gasket is blown, so the engine overheats, and exhaust is getting into the cooling system. The vehicle would not pass emissions w/o a major repair. I don't want to put any more money into it, so I want to sell it "as-is" for a couple hundred bucks to someone who is willing to fix it or wants it for parts.

I am confused about the title and emissions requirements. The State of Colorado requires the seller to provide a proof or emissions (done within 30 days prior to the sale?) But what do I need to do in order to sell the car w/o having emissions done?

- Do I first need to obtain a salvage title?

One guy told me that that's not necessary, that we simply need to write that the car is being sold "AS-IS" on the Bill of Sale, and that's it. But I'm not sure whether that's correct.

Most jurisdictions will allow title transfer without emissions or safety certification so long as you don't try to register (plates, sticker, etc.) the car for the road in that jurisdiction. Colorado /appears/ to be the same. Once you later decide to license the car for the public road, normal emissions and safety certification rules would then apply.

Around here, people sell and or trade all kinds of vehicles that wouldn't pass emissions.They drive them too, if they are in running condition.I see them all the time.

There is a certain old auto repair shop I always take my vehicles to whenever I can't figure out something.When I need a new saftey sticker, the guy scrapes off the old one and puts on the new one.Only takes about five minutes.Next month, I will drive my 1983 Dodge van over there for a new safety sticker. cuhulin

I sold a 71 pick up in Fremont countty ( inspections needed here) to a fellow in Boulder county.( Inspections needed there) Never heard that any thing was needed about inspections. Maybe because of truck year? WW

In mass they have a dollar amount. Nothing is warranteed under $700. Sell it for $699...

I don't know about Colorado but here in California the seller is responsible for any repairs required to make it pass a smog test. That means that if you write a bill of sale that says AS IS it probably isn't worth the paper it's written on. As I understand it someone could buy your car, agreeing to do the repairs themselves, and then come after you to repair it for them. It could get quite ugly. And expensive. I'd try calling the DMV and see what they say about a salvage title.
