smart car - air bag

A friend went over a pothole in her Smart Car and the passenger airbag deployed. The dealer told them that air bags are not covered in the warranty. I appreciate that, if you have a crash, sorting out the air bag is your responsibility, but going over a pothole??

File a complaint with Transport Canada.

NHTSA cannot and will not do anything about it, because cars used in markets other than the US are not under NHTSA's jurisdiction. The Smart is not sold in the US. The appropriate authority for the original poster to contact is Transport Canada.

Hadn't noticed the .ca source and didn't recognize "smart car" as a specific model. Same principle applies though, should be investigated by the mfg. and relevant authorities.

I'd expect either a pretty big pothole or really lousy ground clearance would be needed to cause subframe contact. As Daniel noted, it's also apparently a Canadian issue.

The part about the passenger airbag deploying and apparently not the driver side airbag would seem to indicate a defect outside of any potential of a deep pothole to fool the sensor.

If you don't get any satisfaction from the manufacturer, keep in mind that airbags are very available from wreckers.
