OT: But I value the opinion of you guys!

Tell me how this could happen.

OK, call me an irresponsible parent or what you may. I've been call worse. Well, not really because an irresponsible parent is really a bad thing

My 14yo son and a couple his buddies have been working on an old Chevette to make a circle track dirt race car out of. Well, this evening those boys got the Chevette running and pulled it around front. I think they had to foul the choke closed so it was idling pretty fast. There was oil squirting out from somewhere so my son stopped, where my wife usually parks the van, and got out to see where the oil was coming from and the car took off. It crashed through the next door neighbors tree, through his next door neighbors fence and tried to go through their front door.

I saw the car go by the front window with no driver. I also saw the two buddies running shoulder to shoulder chasing the car and Judd was close behind them.

My son came in half crying and said the Chevette just crashed into Eddie's house. I immediately went out and went over to Eddie's. I told Judd to apologize and tell Eddie we take full responsibility for what happened and I'm sure our homeowners insurance would cover the damage. Eddie's reply was "You shouldn't let those boys fool with that damn junk, that thing is nothing but junk! " Darla, Eddie's wife, was on the phone outside and I heard her tell someone "Those damn Queen's just destroyed my house. "(enter the joke about my last name here)

She called 911, so, the ambulance, rescue squad, the police and the fire chief all came flying in with lights and sirens blasting. Darla told the cops that they haven't had a minutes peace since we moved down here. She kept saying what if it had exploded, what if I had been sitting on the front step, what if, what if. We apologized and are sorry it happened what else can we do?

I'm sure they're going to sue because she told the boys they were going to pay and called em sons of b-tches. This couple is in their late 50's and have no kids. The guy mows his 30'x30' fenced in lawn every other day and plows it up and re-seeds it three time each summer. No hobbies, never go anywhere and never have visitors. After the wrecker company moved the car, I would expect the damage to be around $1000 but I expect them to sue for $5000-$10,000.... Such is life LoL.... After talking with a couple friends, they all said they don't think our home owners will cover the damage. What do you guys think? Seein as the car is just a stripped out hull intend for racing, no auto insurance. VW content ---> I told my son an air cooled VW would make a better circle tracker.

You obviously have neighbors who are retired. And have nothing better to do with their time. Tim is correct. You are going to need a lawyer and this might end up costing you more than you originally thought.

Hate to hear this happened but be thankful no one was injured or killed. A year or two ago we repaired a house that had a Honda crash through the wall and go halfway into the attached two car garage. The car had to go over the outside beam of the foundation. That beam was almost two feet tall and the idiot kid who was driving the car was distraught because his girlfriend (who was in the car with him) broke up with him! He decided the way to get he back was to drive at a very high rate of speed on the wrong side of the road. I don't think it worked. Neither of them were seriously injured. The house required some relatively major repairs and a lot of brick torn down, cleaned up, and replaced (about a third of that wall which was the longest outside wall on the house.) Fortunately the driver's insurance paid for the damages.

Also do call your homeowner's insurance company. They just might cover this, but it would depend on how the policy is put together.

Dave: Irresponsible Parent? I don't think so. Your kid was doing something constructive, you knew where he was, he was learning, experimenting, and expanding his knowledge base, hell he was even having fun. No one was hurt physically. The neighbors have of course have experienced the sanctity of their home being ruffled by a Chevette entering unannounced and uninvited, they understandably are pissed (upset). Let the insurance company and the attorneys work it out, that's why you pay year after year after year.... Good Luck

PS What a great story for the grandkids later on.

Hiya Dave,

First off, I have to agree with the others who suggest seeing a lawyer. Pack up your insurance policies and a written statement of the events and get yourself down to the lawyer's office. This matter may well be settled between lawyers and insurance companies without having to go to court.

However, it seems to me that you have another problem. Your neighbors have their shorts in a knot. Now some of that feeling will probably subside with time, especially with "good behavior" on your side of the fence. But the comments they made in the heat of the moment may be telling. Just as one would drive defensively on the highway to avoid accidents you may find yourself in the position of neighboring defensively to avoid any further entanglements with folks who now seem hostile.

In other words, this thing may just blow over after some sort of settlement is worked out. But, my guess is, they'll be keeping a sharp eye on you for awhile.

Best of luck to you.

Mike

Ouch!

Nothing better than keeping your place as legal as possible for a good while to come.

Is ther reason to believe th neighbor is being a bit more hostile than normal because of something other than the fact they are retired ????

Anyone who had replied to my original post may be interested in what we found out today from my insurance agent. Our agent said our homeowners won't cover the damage nor will the neighbors homeowners cover it (we have the same agent). The agent said the neighbors will have to turn it in on their uninured motorist auto policy and their insurance will eventually collar from us. I certainly believe people should be held accountable for their actions and I'm taking full responsibility for what happened. But what the hell is insurance good for anyway?

*hangs head* Man... I read your original post and thought something like "Oh sh*t. This absolutely sucks because nobody was guilty of any INTENTIONAL harm but unfortunately these days people are @ssholes for the most part and somebody is going to do their best to make some serious cash off of this incident." I think the "Get an attorney" advice is the best you're going to get. You made it clear (at least it was clear to me) that you understand why your neighbors are pissed off. If I was the person who had their house smashed into by a car I'd be more than a little upset, but if the responsible party/parties came forward and said that they were sorry and seemed to really mean it and let me know that their intention was to pay for the damage they caused then I'd like to think I could unload my guns at that point and stop dreaming of retirement at age 40 at their expense. You seem like a nice, responsible guy to me, Dave. I wish you the best in this, especially since I *know* you would have done anything you could have to prevent this if you'd known there was even a remote possibility of a freak accident like this happening. But... Bite the bullet and get an attorney. Nice guys like you don't stand a chance against even an average blood-sucking lawyer. Hire another blood-sucker to keep your loss at a minimum. Maybe they will have some other options for you concerning your insurance, because like more than one person has already said on this thread "WTF do we pay ridiculous amounts of money EVERY G**DAMN MONTH for if we can't get a little of it back?" I mean for real I'll bet that you have paid more than the amount of damage that was caused in this accident in homeowners' insurance over the years. Hell, I'll bet your neighbors have, too but their own "insurance" won't cover them. But now that something happens where you would THINK you could count on the insurance companies to get their thumbs out of their shrivelled up @sses for and give a little back... AGGG!!! What do they do? I'll tell you what they do! They

Thanks for all the suggestions, again. I will call the attorney tomorrow.

The neighbors auto insurance agent called us late this evening to get some information. We told him that if the damage was anywhere around $1000 we may be able to handle it without involving insurance companies at all. The agent said that sounded like a deal to him because the neighbors payments will go up if they collect from a claim. Even though the insurance company will collect from us!

I hate insurance companies!!

Dave, Have you tried coming to an agreement with the neighbor on a repair that you'll pay a contractor, of their choince, to do the work?

I suspect they won;t bite , but if you can afford the price of the repair, it'd sure cut out the middle men and make them happier ,.....................if they are willing to make that happen.

Lawyers are kinda like insurance,................they just make things worse.

I've had 14 year old boys with friends and noise and cars, girls and god knows what else. It sounds like your son's actions caused a lot of noise and damage to rain down on a couple of tidy people who happened to be in his way. Your initial story tells me you are not able to be objective about your son's resposability in this as well as yours. I would try to make amends, get your son involved (it is his mess ). Oh ya, have that lawyer on retainer just in case you still don't get it. You asked for my opinion and that is part of it. As far as him getting a VW, No vehicles until all costs and amends are made to these tramatized folks...Again, my opinion. Dennis
