Is the engine on the right or left?

So an 02 Highlander comes in yesterday, about 25k on the odometer, complaining of a slipping transmission and black smoke from the tailpipe. Hmmm. Indeed, I can't even drive it in the shop, so we get a few guys to push it in. Sure enough, the trans dipstick is bone dry. But wait, it looks like there is approximately double the amount of oil in the crankcase, and there is an aftermarket filter on the block. Hmmm. Of course, the owner is claiming warranty, as he has done all of his service at a dealer. A different dealer then ours. For which he has no records. And can't remember the name. Maybe we should include a Chilton manual for him in our repair estimate, with the maintenance section highlighted.

What a jerk, ruining his engine (and possibly transmission) and then trying to get the dealer to cover it by lying.

Wait a minute... Even if a dealer actually did this, it wouldn't be covered under warranty at all, would it? If it was actually done by a dealer, that dealer would be responsible for repairing the damage. Warranties don't cover parts destroyed through improper maintenance, even if it was a dealer that did it, do they? I'd just tell him he has to take it to the dealer who wrecked it in the first place!

So he did his own oil change, drained the transaxle dry, added engine oil to the engine, end result, no tranny fluid, double engine oil. Not warranty!

Good answer, yes, tell him to have it towed to the servicing dealer who destroyed it. Surely he will fess up as he doesnt want a second tow bill that he will have to pay.
