VW Certified Pre-Owned BS

I just bought an 03 Jetta GLS. They gave me the Certified Pre-Owned 1.9% financing but then cancelled the deal the next day saying that the car can't be a CPO car because it is under mileage. They told me that the car must have a minumum of 12000 miles or be in service for 1 year in order to qualify. This car was originally in service in July 03 and had only 6500 miles. Because it can't be called a CPO car they can't offer the CPO financing rate of 1.9%. I called VW of America and they told me to talk to the dealer! Does anyone know if this crock of sh*t is true? The dealership was VW of Nan Nuys, CA.

**Say okay then, and cancel the whole deal. What kind of dealership does not know the terms of any of their financing deals? It sounds like a common dealership scam. You buy a car and sign the papers. The next day, you get a phone call saying you don't qualify for the loan rate and a large mess ensues. Many people will just say screw it and pay more with a higher rate.

The flip side is that they are incredibly clueless. It *is* true that the car must be in service for 1 year in order to qualify. They should've known that and never have sold you the car under CPO rules.

If you signed the contract that states the terms, is it possible that they might have to lower the price of the car by the difference in interest rates paid on a 1.9% loan over your term versus the interest rates for the lowest % loan terms they can give to you under the circumstances? A threat to your local state agency that oversees the auto industry may help you out. It's their goof, not yours. Its very worthwhile to ask questions....and good luck!

It seems that they are indeed correct in cancelling the deal since they have a right to recind clause if they cannot get the financing that they originally offer. I may have qualified for the 1.9% financing but the car do not fit the criteria of a Certified Pre-Owned Volkswagon. It sucks but I don't believe that there is anything that I can do at this point. They should have known that the car did not qualify but that's not enough of a blunder [negligence] on their part to warrant any futher action. The lesson learned here is that people generally are pretty stupid and as long as all you need is the ability to grunt [and lie without conscience] to be a used car salesperson, get everything in writing and assume that the person you are dealing with knows jack sh*t about what they are talking about.

Unfortunately, this is the way companies operate these days. "He won't notice" "He'll feel stuck so he'll keep the car"

In my opinion the -smart- thing to do is simply return the car and chalk it up as a lesson learned.

It is clear the dealer knew what they were doing - if they didn't they would not have called you THE VERY NEXT DAY "Oh there has been a mistake"

The Official VW website tells us that in order to qualify for Certified Pre-Owned status, a car must pass a 112 point inspection as well as be less than 5 years old and have less than 75000 miles. They never mention a minimum standard [at least on the website] which is indeed either/or 12 months since the in-service date and 12000 miles on the odometer. Fine print indeed. I don't really blame the dealership for their less than thorough knowledge on the subject since this car was way below in both miles [6500] and time in service [9 months].

Yeah, are you keeping the car? I'd go back and say "I can't pay for this without the special financing, can you knock another $1k off the price?" If not, there's ALWAYS another deal somewhere. Since they can't make the financing, the papers you signed no longer obligate you.

why not just take a few days off, make a cross country trip, and return with the car at 12000 miles... and have them redo the paperwork accordingly ;-)

Different states have different laws....and what may work for you in New York, may not work in another state. On a Calif Sales Contract, the buyer must sign an area labeled "Notice of Rescission Rights" which states that if the dealer is unable to complete the financing....they can void the contract and ask for the vehicle back....and they must return all consideration, including trade in vehicle(s) back to the purchaser.

Well....if the contract was fraudulent, then the dealer sure didn't want the risk of getting the Bureau of Consumer Affairs involved.....a good possibility on why they treated you so good. Yes, nobody like bad press, but as any prudent businessoner will do....they won't be held hostage to that possibility if they haven't done anything wrong. IMO, they probably felt, they coudl sell the car to someone else at a similar price as they did with the this poster...and with the legitimate interest rate appropriate for this car. I know, I probably would have walked, simply for knowing I was not going to overpay for a non certified car that they are trying to get a certified price for. A dealer is in the business to make money and not lose a sale if at all possible. It's too bad somebody's error in not knowing the qualifications of a certified automobile cost them and the buyer a vehicle.
