Re: A Scumbag is on the street because the Judge threw out the charges

There is a West African that attended American high school and a US

> university and got a certificate, all in English. Now he is having sex > with a 7-year old relative and claims he needs a translator to effectively > counter the charges against him. The COURT is burdened with getting this > guy an interpreter, but has failed to do so in a timely manner. The judge > threw out the case because the court can not give this guy what he claims > to need -- although by all accounts he has no difficulty with his command > of English. A speedy trial is a guarantee that the prosecutor will not > drag his feet, but in this case the prosecution is not going forward > because the court is dragging its feet. What kind of crap is this!? > > As a further slap in the face, the judge ordered the guy to see a shrink > to assess his command of the language! What in hell does a shrink know > about language?

AND a quick check of the Yellow Pages found seven interpreters in the metro area.

Well before you believe everything you read in the newspaper about someone being guilty, remember the Duke Lacrosse players that were accused of rape and were almost rail roaded by the media and prosecutor.

Who cares how the public wants the law enforced? What does the law itself say how it should be enforced?

Two separate things:

1) You're right: The law says there is a limit to how long someone can be held without a trial. You cannot violate that law. The judge prevented it from being violated.

2) You're right: Some laws involve a ****range**** of penalties, like "two to five years in prison". That's why judges are interested in having a sense of what the public expects.

Besides, who wrote the law anyway? The public's representatives!

People cannot be held for longer than X amount of time without a trial. I don't know what X equals at the moment, but whatever it is, the judge realized the law was being broken. If you disagree, you should write to her and get it out of your system. Then, you should attempt to find out who your elected officials are, and work the have the law changed.

Why was there no trial? Which ultra-liberal lawyer came up with the cockamamie story that this molester didn't know English? Which university did he get his degree from that didn't require him to learn English? How many more people are going to use this precedent to get away with murder?

"Your honor, my client is from the deepest darkest bowels of Mongolia where only 15 people speak the particular dialect he knows. You cannot give him a fair trial because we cannot find him an interpreter."

The prosecutor didn't do his/her job. I'm not following the story closely, but I understand that parties unrelated to the case have found interpreters, simply by making an effort. Write to the appropriate governmental agency and bitch about it. The prosecutor should be shit-canned immediately.

If the clock was ticking and person had to be released, that's the law. If you blame the judge, you're misguided. Or, you think the constitution is a comic book.

Poor kid. Unfortunately, this happens to 'child stars' more often than not.

I thought she had more brains. Gee, I thought Dana Plato did, too...
