An MOT does not prove roadworthiness, nor does lack of an MOT prove a car is unroadworthy.

True, but surely it depends on your definition of roadworthy. It wouldn't suprise me if the powers that be saw it as "black and white" and failing a test would prove it unroadworthy :(
