Why not? My Carlton failed on corrosion to the disks, even though they passed the pathetic brake test on the rollers. When I removed the disc there was rusted sections flaked off from the inside of the disc. I think the MOT includes a visual inspection of things they can see without removing bits or something like that doesn't it?

Tell me a trade that *doesn't* happen in? You talk as though garages are the only business to rip people off. Besides, not all garages do so, certainly none that I have worked for.

BTW - the spare isn't testable, so can't be failed on.
So why argue it?
MOT testers can only fail a car - legitimately - on the fail points in the tester's manual. It's been put online so that we can find out exactly what is a valid fail and kill all these ULs easily.

I would have failed mine for being scored, but the inspector couldn't see that side. I'd *guess* it may have been pitted. I love that the inspection is essentially visual, but asks details about the condition of drum brakes. I can't recall the last time I saw a drum brake where you could see the drum without taking the wheel off and cover. Note I didn't say rust, nor did the inspector. I said corrosion. Before I took over the Escort, my wife drove it for about 5 miles a week and I don't know the last time it had a pad change, although I'd have said there was plenty left on what was fitted.
I think pitting could count, after all it'd only take a bit of infrequent use and storage on the driveway to build up a little rust that would then be wiped off by the next driving phase.

But should be commented on by the tester if it is visibly defective apparently. In the same vein if the brakes pass, but the tester knows that a similar vehicle would normally pass with better results it should be mentioned to the testee that the brake system likely needs some attention.
Reading the tester manual was quite a revelation. Thanks to whoever provided the link. I'm now that bit more knowledgeable about my car and the MOT system.
