Law on travelling for repairs

Hi all,

Sorry if this gets asked a lot.... I'm aware that's it's illegal to use a SORN'ed / not MOT'ed / untaxed car to fetch parts to get it through an MOT and also that it's legal to drive it to garages to get quotes and repairs but what about driving a car to a friend's house for repairs? Can a friend's house be treated as a garage for that purpose?

As I understand it, the only exception to requiring an MOT is to drive it to a test station for a pre-booked MOT. I've never heard anyone say you can use use it to get to a garage for repairs.

IIRC The legalities just say a place of repair. I vouched for a friend of mine who was bringing me a car and was unlucky enough to get stopped with no tax or MoT. I said that I had always repaired his cars for many years and that even though he now lived 80 miles away he still brought them to me for repair, I wrote all that out in English and printed it on a billhead. (I print my own bill heads and I am not vat registered so anyone could do the same. ) The case went to court, but the police backed out on the day !

It IS legal to drive it to a place for repair and MoT If in doubt just drive it to a pre booked test, get the failure and drive it to the friends house, there could be no argument with that.

Umm no. It is legal to drive it to a MOT testing station for a PRE BOOKED MOT only. If it fails the MOT, then repairs may be carried out at the MOT testing station if they have the facilities. If they don't then to comply with the law, the vehicle must be trailered to a place of repair...

I may be wrong in that you can drive it back from the MOT station as long as you are going to a place of repair. (Your residence counts as a place of repair apparently)

It's an offence to drive on the road if your vehicle does not have a current MOT. The only exceptions are if:

  • you are taking it to the testing station for a test which has already been pre-booked. * taking or returning your car from a motor repairers where a previous arrangement has been made. * or taking it home after a test failure.

If that's accurate then I guess it's OK.

For the record, I am the friend in this case, not the driver... he wants my help and to make use of my growing selection of tools.

Nope - you can take IT to a place of repair FROM the MOT station only. You can't take it from your home to a place of repair whether pre-booked or not.

That's quite interesting I'd imagine they would have a go at the idea of it being 80 miles, unless it was quite a specialised vehicle.

That's quite frankly daft, if you have a vehicle that doesn't have an MOT and is in need of repair the only sensible thing to do is take it to a place of repair prior to taking it for an MOT you know it will fail.

I would agree with that interpretation. It would appear that to be completely legal. Peters friend should take it for a pre-booked MOT, knowing it will fail. Then take it to Peters house for repair. Mike.

I still drive without an MOT Certificate? Only if you're going to an MOT testing centre for a test booked in advance or bringing it away from an MOT testing centre, after it has failed the test, to go to a garage for an arranged repair.

Why didn't you post that one in the first place? It disagrees with the one you first posted. FWIW the yell one is wrong - you're allowed to drive it home after a failed MOT - there's no need to get the repairs done at a garage.
