POWs are indeed subject to the rules of the Geneva conventions and military courts, under the Uniform code of Military justice. The terrorist however are NOT POWs, since they are not solders of any country that is a signatory to the Convetions. They are asking to spys or sabators who can be sumarally shot on the battle field.

Now that terrorist have been granted American Constitution protection outside of the US by the Supreme Court, something not even American citizens have outside of the US, fewer of them will be taken prisoner in the future
