In that case it is fail-safe since km/h values > mph values. Just obey the numbers, whatever they are... Anyway, it's claimed somewhere else in the thread that it does not affect MOT.

How many cars have electronic displays for speed? It is so '80s...

Not to pass an MOT it won't.
Up to the end of this year, the speedometer was not even part of the MOT. From 1/1/12, the speedometer must be undamaged, working, and illuminated when the headlights are on. No requirement in the current rules to read in any particular unit.
If it's required to pass an SVA inspection, that's a different matter...
BTW, the one time that you must have a speedometer showing in MPH is when it is being used to take a driving test!

test the condition and operation are listed as test points, if its not able to display in MPH then its operation is not inline with uk specifications i can see a change in the test to correct this omition if its exploited

the Twingo and the Yaris at least, probably some others. Oh, Corvette and I think the Audi A3 (post 2007) supports it as an optional display mode on the panel that normally shows mpg.
I found it useful on one of my previous Jags since the display could be set to show speed in kph on the digital display under the speedometer. That was damned handy and easier to read than squinting at the tiny kph legend on the speedometer.
