Some advice please!

Ok guys, need some advice.

Bought a Fiat Brava about 2 months ago. About a week after I bought it the airbag light came on. After much running about a garage has said that the ACU, Wiring and Clock spring needs to be replaced (this is a second opinion). Cost of this will be something like £400 +VAT and Labour.

The car is still under warranty, but obviously the garage I bought the car from is not too keen to pay up because it would affectively mean they made no profit on the sale. If push comes to shove, do they have to pay?

If the warranty cover doesn't exclude that fault then of course. If not then no.

read it properly it shouldn't cover "electrical" items if it does then screw them over it if it doesn't then live with it for the moment until the mot comes round

Warranty is irrelevant here. Consumer rights are the issue to consider.

I believe that the fault is not a minor one - as well as failing the MOT the airbag may not operate as designed - and I presume that the fault was raised with the seller within a reasonable time?

Most second hand car sellers have their warranties underwritten by insurance companies so the they may not be paying the bill in full.

Your warranty is in addition to your rights in law, which protect you when a car you had only owned for two weeks develops a costly fault which you would not reasonably expect from a car of that age and value.

I cannot see why the warranty wont cover this. Call Fiat UK and DEMAND an explanation to the reason why they wont cover it and leave them in no doubt that you will seek legal advice on the matter. Also insist they contact the dealer in question and discuss and rectify your concerns and also state that they MUST call you back with a satisfactory resolution to your problem within a specified time frame.

The dealer can try and hide behind the terms of his 'warranty', but the sale of goods act applies to everything.

Depends on your warranty but the phrase mechantable quality doth spring to mind. Along with the phrase they're unlikely all to be buggered.
