Well, BMW managed to contact my brother, when his old 5th owner very battered 320i was suddenly recalled europe wide for a fault rectification.
Well if that's the case, then none of them should have any excuse. The legal grey area would be as to whether or not they'd be entitled to the data from the DVLA if it wasn't a safety-critical recall, which it could be agued that a cambelt-related issue isn't. I'd argue that it is, as I can't imagine it'd be too pleasant having a cambelt snap at 70mph engaged in top gear in the outside lane of the motorway. That doesn't smack of being desperately safe to me.
Out of interest, how old was the car at the time they recalled it?

Load on belts, radius of pulleys (cracking), free lengths (vibration), quality of load damping (if any) all vary, as do the relative dimensions of the belt. Basically just quality of engineering/degree of cost cutting.
