Changin mind about buying a truck, should the dealer return the deposit.

May30, bought a new truck off the lot, signed agreement and gave dealer $4000 deposit, with sale to be completed at a later date.

Overnight had a change of heart, and decided to cancel the buy.

May31 morning drove to dealer and notified sales manager that we changed our mind, and would like the deposit back.

Manager told us that he didn't have to return any of the deposit to us, But because he was a fair man, he would return 1/2 of the deposit.

He said that we could take the dealer to small claims court, he didn't care.

Is it normal for a dealer to keep 1/2 of the deposit?

Don't even bother with courts. Useless.

Do you have any local TV News stations there?

We have several here, they have 'Troubleshooters". Neat thing about them is one phone call from a TV station to the Shyster Dealer will do allot for you to get your rebate back.

Just imagine what TV story will do to the dealer.

Depends on the state and the terms of your deposit. I imagine he's an upset would be seller.

Have your attorney read the contract that you signed. That contains the answer to your question.

The sales manager of course is upset of a failed sale. His job is to sell.

In this case the truck was on the lot, I signed the agreement near closing time, and reneged on it at next day at opening exactly.

The truck never left the spot on the car lot. Purely a paper game.

$2000 seems unfair to me.

It doesn't matter what you think is "unfair". What's the law in your state? If the law says there's a "cooling off period" or whatever, you might get some/all of it back. If the law says you don't get a dime back, then you screwed up. In that case, if you get anything at all back, it's due to the good graces of the dealer - nothing else. The "poor, little ignorant me" defense is lame and tiresome.

First thing is. You can't change your mind after you give a deposit.

Second is : Was it a refundable deposit or not. Im guessing refundable, but the dealer knows it will cost you just as much to get it back through attorney fees, as it is to let it go. Id take him to small claims with your contract that states its refundable . And hope to get it back.

Or get an attorney, Or call the news.

But you havn't stated if its refundable or not

Now I bet they sell the truck fast to take the option to buy it away.
