Stolen Discovery

X204RBS This beloved vehicle was stolen 13 weeks ago. I have today been told by the insurance company today

"It could not have been removed un-lawfully without the participant in the removal of the insured vehicle being in possession of the specific vehicle keys"

They are telling me I am a liar in effect and will get no benefit from my insurance, I had

18 yrs without a claim. I still have 2 sets of keys in my possession. I am at a loss and really upset now, as it seems I also have to pay for 12 weeks courtesy car hire, (a bloody CLIO) I need help as I cant afford it. Anybody else had same sort of thing?

To be quite honest in the $hit as it aint quite paid for yet. Stu

Strange insurers of course the ability to obtain keys dishonestly for a vehicle is only one of the methods villians use to nick them otherwise there would be no car theft at all asides from those left running outside the shops, solictors letter I reckon or you could just advise them in view of their letter you will be advising a solictor.to take action . Erm, You didn't leave the keys in it did you? I'm afraid if you did, then you're sunk.

Write to them formally and ask what grounds they have for believeing so, pointing out that you still have the keys within your posession. Tell them that the matter is not satisfactorily resolved you intend to refer the case to the insurance ombudsman.

Which insurance company? Seems they are in need of a little publicity.

Without the full story it sounds to me as if they are trying it on.

Politely and firmly, ask them to prove "beyond reasonable doubt" that the vehicle was stolen with the use of the keys.

Avoid the use of the word "you" when on the phone. It's not the teletubbie who is personally responsible for giving you grief but the company behind them. Refer to company by name, this prevents the perfectly natural negative response of being "accused" of something in the teletubbie. Get them on your side and they are more likley to be go that little bit further for you. Rant, shout or be abusive and they'll do the barest minimum.

why do they think it was stolen using a key?

Dave Liquorice uttered summat worrerz funny about:

Civil law works "On the balance of probability", "Beyond reasonable doubt" is for Criminal law.

But I still see the point anyway.

balance of probability says to me that if he still has both sets of keys, the vehicle doesn't have a set with it now...

Besides, to remove vehicle unlawfully without keys:

1) smash window 2) take off handbrake and put in neutral 3) load onto trailer. 4) drive away.

Insurance ombudsman.... is there such a thing and if not why not?

and failing that, get onto the daily maul...

Spoke to my Dad about this (who's been an insurance broker for the past

25 years) and he said it sounds like they think you left the keys in it (surprisingly common) and you aren't insured for theft if that is the case - and rightly so! However, if you have both sets of keys in your possession he suggested you speak to someone with authority, or write to them explaining you have both sets of original keys - but don't be funny with them. He said it all depends on the insurance company in question as to how easy they will be to deal with. Of course, if you had used a broker they would have been able to argue your corner for you, most likely with a good result, rather than you having to fight it yourself!

Whatever, don't panic - it is fairly typical for an insurance company to try and get out of paying if they can, and will usually back down once they get their facts straight.
