Opinons wanted...

My buddy just bought a Stude and without going into details (at least not yet) the car arrived and did NOT have Twin Traction as represented and also has a torn up clutch and/or transmission...I haven't had time to determine which but preliminary checks indicate most likely both... I told him to tell the seller that a rebate should be had for the non TT and a kick in for whatever the other problem is and all will be well; no harm no foul and everyone is happy. The seller called me and fed me some mumbo jumbo and also talked fast and left the conversation early...I was not rude (imagine that..actually held my famous temper..) but didn't back up either. Am I out of line in what I am 'suggesting'..? The car has other problems, but they were told about up front. Seller professes to be some sort of 'mechanic'.. Studebaker George

Legally, I would think that the only recourse is the lack of a TT if it were part of the sales presentation. Generally, used cars are considered "AS IS" and most courts by precedent tend to hold that view.

But, I hate to have people pissed at me so I try to always disclose any deficiencies regarding anything I sell. Hate to have keep lookin' over my shoulder...

BTW, I working on boxing up that grille...
